1. Who we are
Listen In (the “App”) is developed by JDNICAPPS LEARNING SOFTWARE LTD, registration number HE 484154, Rodou 1, Kiti, 7550 Larnaca, Cyprus (“we”, “us”, “our”). We are the data controller for the personal data described in this policy, except where we say that another company is responsible. You can contact us at info@jdnicapps.com. This policy covers the App. How our website uses cookies is explained in the Website Cookie Notice.
2. Summary
- There is no account. We do not ask for your name, email address or phone number.
- Your learning progress stays on your device. We do not receive it.
- The App shows ads. Our advertising partner collects device information, including advertising identifiers, to show and measure ads. Ads are personalised only with your consent.
- When the App downloads lesson audio from our cloud storage, the server sees your IP address so it can send the files. We do not use this to identify you.
- If you email us, we use your details to reply.
- We do not sell your personal data.
3. Data stored on your device
Your progress, scores and settings are saved locally on your device so the App remembers where you are. This data is not sent to us or to any third party, and we cannot access it. Deleting the App deletes it, apart from any copy in your device backup.
4. Downloading lesson audio
Some lesson audio is stored in the cloud and downloaded to your device when needed. To send the files, the server receives your IP address and basic technical information about the request, such as the time, the file requested and the type of device or App version. This information is used only to deliver the audio and keep the service secure. It is not used to identify you or to build a profile of you.
Our cloud hosting provider processes this information on our behalf, under a contract that requires it to protect the data and use it only on our instructions. Any server logs are kept only for a limited period for security and troubleshooting. Our legal basis is our legitimate interest in delivering the App’s content (Article 6(1)(f) GDPR). Once downloaded, the audio stays on your device.
5. Advertising
5.1 The App is free because it shows ads, served by Google AdMob, provided by Google Ireland Limited (our “advertising partner”).
5.2 To deliver ads, our advertising partner’s software in the App collects data from your device, which may include:
- your device’s advertising identifier (IDFA on iOS, Advertising ID on Android), where available;
- your IP address and the approximate location derived from it;
- device type, operating system, language settings and App version;
- information about the ads shown to you and how you interact with them, such as views and clicks.
5.3 This data is used to show ads, limit how often you see the same ad, measure how ads perform, detect fraud and, if you consent, show ads based on your interests.
5.4 Your choices. If you are in the European Economic Area, the UK or Switzerland, the App asks for your choices when you first open it, before any personalised advertising. You can manage ads at any time by tapping the three dots (or the AdChoices icon) in the corner of an ad, where you can see why an ad was shown, stop seeing it and control ad personalisation. You can also reset your consent choices by deleting and reinstalling the App, which shows the consent screen again. If you decline, you may still see non-personalised or limited ads, which use less data. On iOS, the App asks your permission through Apple’s App Tracking Transparency prompt before your advertising identifier is used for tracking. You can also reset your advertising identifier or limit ad personalisation in your device’s privacy settings.
5.5 Our advertising partner processes this data as an independent controller under its own privacy policy, available at policies.google.com/privacy. It may transfer data outside the European Economic Area, using safeguards such as the European Commission’s Standard Contractual Clauses or the EU–US Data Privacy Framework.
5.6 Legal basis. We rely on your consent (Article 6(1)(a) GDPR, and the rules on storing and accessing information on your device) for personalised advertising and for any access to your device that requires consent. Where consent is not required, we rely on our legitimate interest in funding the App through advertising and preventing ad fraud (Article 6(1)(f) GDPR). You can withdraw consent at any time as described in section 5.4.
6. When you contact us
If you email us, we process your email address, your name if you give it, and the content of your message, so that we can reply. Our legal basis is our legitimate interest in answering enquiries (Article 6(1)(f) GDPR). We keep correspondence for up to 24 months after it ends, unless we need it for longer to deal with a legal claim. Our email provider stores these messages on our behalf.
7. App stores
Apple and Google process data when you download the App or make a purchase through their stores. They do this as independent controllers under their own privacy policies. They may give us aggregated statistics, such as download numbers and, if you have chosen to share them, crash reports, which do not identify you to us.
8. Device permissions
The App uses internet access, which is needed to download lesson audio and to show ads, and audio playback. It does not access your microphone, camera, contacts, photos or precise location.
9. Who receives data
We do not sell personal data. The only parties who receive data through the App are our cloud hosting provider (section 4), our advertising partner (section 5) and the app stores (section 7). Emails you send us are held by our email provider on our behalf.
10. Children
The App is designed for adult learners and is not directed at children. You must be at least 16 years old to use it. If you believe someone under 16 has used the App, please contact us.
11. Your rights
11.1 Under the GDPR you have the right to access, correct or delete your personal data; to restrict or object to its processing, including processing based on legitimate interests; to data portability; and to withdraw consent at any time, without affecting processing that took place before you withdrew it.
11.2 We hold very little data about App users: short-lived server logs from audio downloads (section 4) and any emails you send us. We cannot link server logs to a named person, so we can only act on requests where we can identify the data concerned. For advertising data, you can use the choices in section 5.4 or contact our advertising partner directly. We are happy to help: email us at info@jdnicapps.com.
11.3 You have the right to complain to the Commissioner for Personal Data Protection in Cyprus (www.dataprotection.gov.cy) or to the data protection authority in the country where you live.
12. Security
We use reputable providers and take reasonable steps to protect the personal data we hold. Data stored on your device is protected by your device’s own security settings.
13. Changes to this policy
We may update this policy when the App, our partners or the law change. The “Last updated” date shows when it last changed. For material changes, we will notify you in the App.
